IOWA AMENDATORY ENDORSEMENT
The Arbitration Agreement provision is deleted in its entirety and replaced with the following:
Any dispute, claim or controversy arising out of or relating to this TERMS OF PROTECTION or the breach, termination, enforcement, construction, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, may, upon written agreement by YOU and US be determined by final and binding arbitration in the state of Iowa. We both waive the right to resolve any dispute, claim or controversy arising out of or relating to this TERMS OF PROTECTION by a judge and/or jury. We also agree not to participate as a class representative or class member in any class action litigation, any class arbitration or any consolidation of individual arbitrations against each other.
The arbitration shall be conducted in accordance with the Commercial Rules of the American Arbitration Association. Judgment on the Award may be entered in any court having jurisdiction. This TERMS OF PROTECTION and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of the State of Iowa, exclusive of conflict or choice of law rules.
The parties shall maintain the confidential nature of the arbitration proceeding and the award, except as may be necessary to prepare for or conduct the arbitration hearing on the merits, or except as may be necessary in connection with a court application for a preliminary remedy, a judicial challenge to an award or its enforcement, or unless otherwise required by law or judicial decision.
Should YOU remain dissatisfied following OUR final written response, YOU may refer YOUR case to the Department of Insurance for YOUR state of residence. The Department of Insurance is the governing body that assists on complaints about general insurance products. This does not affect YOUR right to take legal action.
